A city eruv is not created by drawing a line around a neighborhood. The line on a map has to correspond, point by point, to an enclosure that halacha recognizes on the ground. Along the perimeter there must be valid mechitzos, or valid tzuros hapesach closing the places that would otherwise be open, subject to the halachos governing the area being enclosed.

That makes continuity fundamental. A fence may serve as a mechitza for one stretch, a building wall may be relied on elsewhere, and poles with a wire above them may form a tzuras hapesach across another opening. But the different parts have to join into one halachically continuous enclosure. A map can show where the intended boundary runs. It cannot by itself establish that every wall, opening, post, wire and junction along that line is valid.

A boundary has to exist on the ground

The basic form of a tzuras hapesach is stated by the Alter Rebbe in Shulchan Aruch, Orach Chayim 362:20:

מהו צורת פתח? קנה מכאן וקנה מכאן ... וקנה על גביהם

What is a tzuras hapesach? A post on this side and a post on that side ... with a crosspiece above them.

The Alter Rebbe continues that the two side posts must be at least ten tefachim high and must be positioned beneath the upper member. If they are displaced from beneath it, even slightly, the structure does not have the form of an entrance and is invalid. The same se'if distinguishes between a crosspiece placed over the side posts and one attached improperly from the side.

These details explain why a utility pole and an overhead wire are not automatically a tzuras hapesach merely because they appear next to each other. Where an existing utility wire is used, the halachic post beneath it has to be in the right place. Where an opening is closed with a purpose-built korah or wire, its uprights and upper member likewise have to form the required doorway. The full halachos of tzuras hapesach apply regardless of how simple the line looks on a map.

There is a second issue whenever the route relies on actual walls or fences. An enclosure can contain openings, but the status and size of those openings matter. In 362:18 the Alter Rebbe states that an enclosure whose open portions exceed its standing partitions is not valid in the ordinary case, and adds:

ובלבד שלא יהיה במקום אחד פרוץ יותר מעשר אמות

provided that there is not, in any one place, an opening greater than ten amos.

A valid tzuras hapesach can address openings in circumstances where halacha recognizes it as effective. The separate questions of omed merube al haparutz, large breaches, and what may count as a wall are treated in detail on Exterior Walls and Omed Merube in Crown Heights. The separate question whether an area has the status of a full reshus harabim is also decisive, because the Alter Rebbe rules in 364:4 that a tzuras hapesach alone does not suffice, according to Rabbinic law, to permit carrying in a complete reshus harabim.

The physical route therefore cannot be evaluated by asking only, "Is there a wire?" The real question is what halachic enclosure exists at every stretch of the perimeter, and whether the different forms of enclosure connect without a disqualifying break.

What the published Crown Heights route covers

The published map is not limited to the central streets normally meant when people say Crown Heights. It is presented as the boundary for Crown Heights, Brownsville and East Flatbush. The KML as it stood on August 2, 2026 extended approximately from Atlantic Avenue on the north to the Flatbush Avenue and Triangle Junction area on the south, and from the Prospect Park and Prospect Heights side on the west to the Broadway Junction area on the east.

Its coordinate bounds were approximately:

  • west: longitude -73.9644637
  • east: longitude -73.8988254
  • south: latitude 40.6292116
  • north: latitude 40.6809784

That is a span of roughly 5.5 kilometers east to west and 5.8 kilometers north to south. Those dimensions are not the perimeter length. They simply show the scale of the area represented by the published data.

The KML contains six polylines with a total of fifty coordinate vertices. Five features appear to make up the principal outer route, while a separate five-vertex feature is labeled park fence.

The fifty vertices are points used to draw the route. They are not fifty identified halachic structures. The KML does not label each stretch as a wall, fence, lechi, utility pole, wire, korah, bridge structure or other form of enclosure. Apart from the feature called park fence, the line features themselves contain no street-by-street component description.

That distinction matters. A person looking at the map can see the intended geographic boundary. He cannot use the map alone to determine what physical object supplies the mechitza at a particular block, what closes a particular road crossing, or how two different kinds of enclosure join at an intersection.

The KML is a route drawing, not a survey

Several of the line features meet at exactly the same published coordinates. Line 1 and Line 4 share their Crown Heights endpoint. Line 1 and Line 2 share the same Prospect Heights endpoint. Line 3 and the dated two-point feature share an endpoint near Broadway Junction.

Two other apparent joins do not coincide exactly in the KML. Near the southern Flatbush Avenue end, the endpoints of Line 2 and Line 3 are about 16 meters, or 52 feet, apart. Near the eastern Atlantic Avenue section, the endpoints of Line 4 and the dated feature are about 3.3 meters, or 11 feet, apart.

Those differences are important to describe accurately, but they should not be turned into more than the data can prove. A cartographic gap of several feet does not establish that there is a physical breach on the street. The map may have been drawn approximately, and a valid physical structure may exist between two plotted points. Conversely, a line that joins perfectly on a screen does not establish that the corresponding objects on the ground form a valid halachic junction. The KML is useful for locating the intended route, not for replacing inspection and measurement of the route itself.

Walls, fences, poles and wires

The published description of the Crown Heights eruv says that it is omed merube and uses "80% walls." No underlying wall lengths or calculation are published with the KML. The map does, however, contain the specifically labeled park fence feature, and the construction material published with the route shows that the remaining system is not being presented as walls alone.

One construction video is specifically presented as the making of a korah or tzuras hapesach at an underpass for the Crown Heights eruv. Two short construction clips are presented under titles describing the building of the Crown Heights eruv and the use of street lights. The public About material separately identifies a person responsible for eruv building and maintenance and another person as the weekly checker.

Taken together, the published material describes a mixed urban enclosure. Existing walls and fences are relied on for substantial stretches, while purpose-built or adapted tzuros hapesach are used to close openings where the route does not have a continuous physical wall. That is a normal kind of engineering problem for a city eruv. The halachic question is whether each particular structure relied on actually qualifies, and whether every transition between structures is sound.

For example, if an existing overhead wire is used over a road, the relevant vertical member has to be beneath the wire in the manner required for tzuras hapesach. If a separate lechi is installed at the base of a utility pole, the wire must align with the lechi. At a corner, the route has to turn through a halachically valid junction. Where a fence is interrupted by a gate, driveway, path or roadway, the opening has to be accounted for. Where an underpass or other large road opening is crossed, the form that closes that opening has to satisfy the applicable halachos.

This is why a useful physical boundary description needs more than the colored perimeter. For each change in construction, it should be possible to identify what the route is relying on before the change, what it relies on after the change, and what creates continuity at the junction.

The published KML does not presently provide that component-by-component schedule. It therefore shows where the intended boundary runs, but it does not by itself establish the complete physical case for the enclosure.

Openings and breaches cannot be averaged away

A long route can be mostly bounded by strong existing structures and still require careful treatment of its openings. Individual breaches have their own halachic significance. The treatment of one opening may depend on its width, its use by the public, the surrounding mechitzos and the tzuras hapesach placed there.

That is especially relevant to a route of this size. It passes through or alongside major urban streets, park boundaries and transportation infrastructure. Every place where a relied-on wall stops, every road that cuts through it, and every place where a wire, fence or building line changes has to be joined to the next valid component.

The reported "80% walls" figure is therefore not, by itself, a description of a complete enclosure. To evaluate that figure one would need to know what total perimeter is being used as the denominator, what structures are included as walls, their lengths, where they are interrupted, and what halachic device closes each remaining opening. Those questions belong to the full exterior-walls analysis, but the physical boundary cannot be understood without recognizing that they exist.

What a weekly inspection establishes

The route is publicly described as being checked every week. A one-page weekly notice preserved from Parshas Eikev 5786 states:

The Eruv for the Crown Heights, Brownsville, and East Flatbush communities has been inspected and is kosher for this Shabbos.

That kind of notice addresses an important practical question: whether the people responsible for the route are reporting it intact for that particular Shabbos. A city eruv can be damaged by construction, utility work, weather, vehicles or ordinary changes to poles, wires and fences. Continuing inspection and repair are therefore necessary even after a route has first been built.

But a weekly inspection answers a narrower question than the original halachic validity of the route. An inspection can determine that a designated wire has not fallen, that a lechi is still in place, or that a known fence has not been broken. It does not by itself establish that the original designation of each structure as a valid mechitza or tzuras hapesach was correct, that a wall calculation is halachically sound, or that the area can be enclosed by these methods under the applicable laws of reshus harabim.

The preserved Eikev notice gives the weekly conclusion, but it does not publish an inspection log, a list of the route points checked, defects found, repairs made, the time of inspection, or the measurements used. It also bears no individual signatory. The public status banner is updated for different weeks, which is useful as an operational notice, but each such notice is necessarily week-specific.

The local psak directly addressed the proposed walls

The physical route is only one part of the Crown Heights question. The Crown Heights Rabbonim have repeatedly ruled that carrying in the neighborhood remains prohibited, and one of their later rulings addressed the publicized use of exterior walls specifically.

On 20 Teves 5783, Rabbi Avrohom Osdoba and Rabbi Yosef Yeshaya Braun signed a Beis Din letter returning to the subject of the eruv. After restating the longstanding position of the local Rabbonim, they wrote:

מובן ופשוט שאין כל שינוי בשלילה מוחלטת הנ״ל, גם לאחר הפירסום ע״ד התקנת "מחיצות" כביכול מחוץ לשכונתנו

It is understood and obvious that there is no change in the above absolute rejection, even after the publicity concerning the installation of supposed "mechitzos" outside our neighborhood.

The letter concludes with the practical ruling:

אסור בהחלט לטלטל ברחובות השכונה בשבת ו"עירוב" זה כמאן דליתא

It is absolutely forbidden to carry in the streets of the neighborhood on Shabbos, and this "eruv" is as though it does not exist.

That is particularly relevant to a boundary presented as relying heavily on exterior walls. The local ruling did not treat publicity about such walls as changing the psak for Crown Heights.

The Beis Din repeated the practical ruling again on 4 Tishrei 5786. In the signed Hebrew letter, Rabbis Osdoba and Braun stated:

בשכונת קראון הייטס וסביבותיה אסור לטלטל ברה״ר ולהוציא מרשות לרשות בשום אופן בש״ק ויום הכיפורים

Within Crown Heights and its vicinity, it is forbidden to carry in a reshus harabim and to transfer from one reshus to another in any manner on Shabbos Kodesh and Yom Kippur.

The existence of a mapped perimeter, construction work and weekly checking therefore should not be confused with the practical psak of the Crown Heights Beis Din. The physical information tells us what boundary is being proposed and maintained. The local Rabbonim's ruling tells Crown Heights residents and visitors whether they may rely on it for carrying. Their answer remains that they may not.
